Sections 77 to 81 confer certain powers on
controller of patents. In any proceedings before him under this Act, he shall
have the powers of a civil court while trying a suit under the code of civil
procedure, 1908 in respect of certain matters. Further, he may correct any
clerical error in any patent or in any specification or other document filed in
pursuance of an application for patent or any clerical error in any matter
which is entered in the Register of Patents. Further, in any proceeding under
this Act before the controller, he may take oral evidence in lieu of, or in addition
to evidence by affidavit, or may allow any party to be cross-examined on the
contents of his affidavit.
