The concept of deemed public company was introduced in 1960 by inserting s.43A. It contemplated for deeming a private company as a public company in certain circumstances.
The companies (Amendment) Act 2000 has abolished the concepts of the ‘deemed public company.’ If a deemed public company becomes a private company on or after the commencement of this Act, then such a company shall inform the registrar of companies along with the original certificate of incorporation for registration and insertion of the word ‘private’ in its name and memorandum and articles of association.
